Welcome to Paw & Home Market. The terms “we,” “us,” and “our” refer to Paw & Home Market. We operate this online store and website, including the information, content, features, products, and services made available through it (collectively, the “Services”). Our store is powered by Shopify.
These Terms of Service, together with the policies referenced below, describe your rights and responsibilities when you access or use the Services.

SECTION 1 – ACCESS AND ACCOUNTS

You agree to provide accurate, current, and complete information when creating an account or placing an order.
You are responsible for safeguarding your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.
SECTION 2 – PRODUCTS AND PRODUCT SAFETY
We make reasonable efforts to accurately display and describe our products. However, colours, dimensions, packaging, and appearance might vary slightly from images because of screen settings, manufacturing updates, or supplier changes.
Product descriptions, availability, pricing, and specifications may be changed without notice. We may discontinue a product or limit the quantity available to a person, household, geographic area, or jurisdiction.
Pet toys and accessories must be used with appropriate supervision. Inspect pet products regularly for damage or loose parts, discontinue use if damaged, and select products appropriate for the animal’s size, age, and behaviour.
Nothing in these Terms limits warranties or consumer rights that cannot legally be excluded.
SECTION 3 – ORDERS
Submitting an order is an offer to purchase. An order is accepted only after we confirm acceptance and successfully process payment.
We may refuse, limit, modify, or cancel an order when reasonably necessary, including because of suspected fraud, pricing or inventory errors, delivery restrictions, supplier availability, or violation of these Terms.
If we modify or cancel an order, we will attempt to notify you using the email address, telephone number, or billing information provided with the order.
Review your order carefully before submitting it. We will try to accommodate cancellation or address-change requests, but changes cannot be guaranteed after processing begins.

SECTION 4 – PRICES, CURRENCIES, AND BILLING
Prices, promotions, and discounts may change without notice. The price charged is the price shown at checkout when the order is submitted.
Prices may be displayed in different currencies depending on the customer’s market or location. Currency conversion rates and rounding may change.
Unless expressly stated otherwise, displayed prices do not include applicable taxes, customs duties, import fees, shipping charges, or handling charges. Any applicable amounts will be displayed at checkout when available.
You agree to provide accurate and complete billing and payment information and confirm that you are authorized to use the selected payment method.
SECTION 5 – SHIPPING AND DELIVERY

Delivery dates are estimates and are not guaranteed. Delays may occur because of carriers, weather, customs, holidays, address problems, supplier processing, or other circumstances outside our reasonable control.
Risk of loss and responsibility for an order will be determined according to applicable law. We will reasonably assist customers with carrier investigations involving lost, damaged, or missing packages.
SECTION 6 – INTELLECTUAL PROPERTY
The Services and their content—including text, graphics, photographs, videos, logos, designs, product descriptions, and website layout—are owned by or licensed to Paw & Home Market, Shopify, or their respective rights holders and are protected by applicable intellectual-property laws.
You may use the Services only for lawful, personal, and non-commercial purposes. You may not reproduce, distribute, modify, republish, publicly display, sell, scrape, or exploit content from the Services without prior written permission from the applicable rights holder.
Shopify and its associated names and logos are trademarks of Shopify. Other names, logos, and marks belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, applications, payment services, tracking services, or other functionality operated by third parties.
Third-party services are provided according to their own terms and policies. We do not control or guarantee third-party tools and are not responsible for their operation except to the extent required by law.

The Services may contain links to third-party websites. We are not responsible for reviewing or guaranteeing the accuracy, safety, or practices of third-party websites.
Accessing a third-party website is at your discretion. Complaints or questions concerning third-party products or services should be directed to the applicable third party, unless the issue concerns a purchase made directly from Paw & Home Market.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Paw & Home Market is powered by Shopify, which provides the ecommerce platform used to offer the Services.
Purchases made from our store are transactions directly between you and Paw & Home Market. Shopify is not the seller of products offered by Paw & Home Market and is not responsible for fulfilling our customer orders.

Because Shopify hosts the store, certain information may be processed by Shopify and its service providers in Canada, the United States, or other countries, as described in the applicable privacy policies.

If you submit reviews, photographs, suggestions, comments, or other feedback, you confirm that you own or have permission to submit that content and that it does not violate another person’s rights.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, edit, and distribute submitted feedback for operating and promoting the Services.
We may remove content that is unlawful, abusive, misleading, infringing, fraudulent, or otherwise inappropriate. You remain responsible for the accuracy and legality of content you submit.

Information on the Services may occasionally contain typographical errors, pricing errors, inaccurate descriptions, incorrect shipping estimates, or availability errors.
We may correct errors, update information, or cancel affected orders when reasonably necessary. If a paid order is cancelled, the applicable payment will be refunded.

- To submit false, misleading, defamatory, or harmful information

We do not guarantee that the Services will always be uninterrupted, secure, or error-free. We do not exclude warranties, conditions, remedies, or consumer rights that cannot legally be excluded or limited.

To the fullest extent permitted by law, Paw & Home Market and its service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or products.
These limitations do not apply where liability cannot legally be excluded or limited, including rights available under applicable consumer-protection laws.
SECTION 17 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Paw & Home Market against third-party claims, losses, or reasonable legal expenses resulting from your unlawful use of the Services, your material breach of these Terms, or your violation of another person’s rights.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in effect.
SECTION 19 – WAIVER AND ENTIRE AGREEMENT
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
These Terms and the policies posted on our website constitute the agreement between you and Paw & Home Market regarding use of the Services, except where additional written terms apply.
SECTION 20 – ASSIGNMENT
You may not assign your rights or obligations under these Terms without our prior written consent.
We may assign our rights or obligations as part of a business reorganization, transfer, sale, or as otherwise permitted by law.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without excluding any mandatory consumer-protection rights that apply in the customer’s place of residence.
Subject to any rights that cannot legally be waived, disputes will be submitted to the courts of competent jurisdiction in Ontario, Canada.
SECTION 22 – CHANGES TO THESE TERMS
We may update these Terms by posting a revised version on the website. Material changes will take effect on the date specified in the notice or as otherwise required by law.
Your continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms, subject to applicable law.
